Presidential Decree 802 of 9 December 1996

Concerning the State Programme on Solving the Legal and Social Problems

Relating to the Repatriation of the Meskhetians Deported from Georgia

1. A State Programme shall be presented by the State Commission on solving the legal and social problems relating to the repatriation of Meskhetians deported from Georgia. The Programme concerns the management, co-ordination and supervision of the repatriation process, and will define the functions and tasks of the Government in this sphere, with a view to create and improve the legal basis and social security of returning Meskhetians.

2. A State Commission shall be established and tasked with drafting a State Programme on solving the legal and social problems relating to the repatriation of Meskhetians deported from Georgia, with the following membership:

3. The State Commission shall establish a permanent working group with the membership of interested Ministries and entities.

4. Commissions lead by the Attorneys of the President shall be established at the regional level within a month, to supervise and control at the local level the implementation of the activities envisaged in the programme.

5. Commissions shall be established in the Autonomous Republic of Achara and after the achievement of Georgian territorial integrity, in the Autonomous Republics of Abkhazia and Tskhinvali.

6. The Ombudsman is requested to review the reports concerning the protection of human rights in the repatriation process submitted by the Georgian Government, foreign governments and non-governmental organisations, and to present them for consideration every first quarter of the year.

7. The proposal of the Commission on Human Rights Protection and Ethnic Minorities to investigate cases of violation of the law in relation with the process of repatriation of the Meskhetians in 1988-1991 and to arrange hearings is approved.
